Pool Fence Installation

A pool fence has to meet the New York State Residential Code, from its height down to the gap under it. The gate and its latch carry more of those rules than any other part.

Drawing of a pool gate swinging shut and latching. The 2025 Residential Code of New York State, section R328.4.2.7, requires every gate in a pool barrier to be self-closing and self-latching.

The kids have been asking since March. The pool goes in next month, and nobody is allowed in the water until the barrier around it passes. On Long Island that barrier is a fence and a gate built to the New York State code, plus whatever your village adds on top.

What the state code requires

New York’s 2025 Uniform Code took effect on December 31, 2025, according to the Department of State. In the 2025 Residential Code the pool rules sit in section R328. The 2020 code had them in R326, so older handouts still use that number. The Town of Islip’s Division of Building hands out the 2025 text.

Rule and sectionWhat the 2025 code says
Which pools (R328.2)Any pool that can hold water more than 24 inches deep, in ground, above ground or on ground, plus hot tubs and spas
Height (R328.4.2.1)Top of the barrier at least 48 inches above grade, measured on the side away from the pool
Bottom gap (R328.4.2.1)No more than 2 inches between grade and the bottom of the barrier
Picket spacing (R328.4.2.3 and R328.4.2.4)No more than 1-3/4 inches between verticals when the horizontal rails are under 45 inches apart; no more than 4 inches when they are 45 inches or more apart
Gate closing (R328.4.2.7.1)Every gate self-closing; a walk-through gate opens outward, away from the pool
Gate latching (R328.4.2.7.2)Every gate self-latching; a release reachable from outside sits at least 54 inches up; a release only on the pool side sits at least 3 inches below the top of the gate
Locking (R328.4.2.7.3)Gates “securely locked with a key, combination or other child-proof lock”
Pool alarm (R328.6)Pools and spas installed or substantially changed after December 14, 2006 need an approved pool alarm
During construction (R328.4.1)A temporary barrier while the pool is being built, replaced by the permanent one within 90 days of the pool permit

Villages and towns can ask for more

The state code is the floor. The Village of Malverne’s printout of the code carries two village notes: it requires a 5 foot high solid barrier, and it allows only one gate into the pool area. In the Town of Hempstead, News12 reported in June 2019 that a Baldwin homeowner was cited because the town code says even nonpermanent pools need permits and safety fencing. If you live in an incorporated village, call the village building department before you order anything.

Why the gate gets the most rules

The CPSC reported in June 2026 that an average of 376 children under 15 drowned each year from 2021 to 2023 in pool or spa incidents, nearly 80 percent of them under five, and over 70 percent of the deaths happened at homes. It recommends layers of protection, including self-closing, self-latching devices on fence gates and doors to the pool. A gate propped open defeats the fence, so look at the hardware as closely as the panels.

CertainTeed’s Bufftech guide lists self-closing TruClose hinges and MagnaLatch magnetic safety gate latches among the gate hardware for its vinyl fences.

Aluminum, vinyl, wood or removable mesh

Any of them can meet the code if the height, gaps and gate are right. Family Fence in Bellmore sums up the trade off in its May 2026 post: aluminum for a clean, open look, vinyl for privacy and a solid backdrop, wood for a natural look that blends with planting. It also sells Baby Loc removable pool fences, which set up and come down.

For mesh, the CPSC’s barrier guidelines say the bottom should sit no more than an inch above the deck, and the posts should be at least 48 inches high and no more than 40 inches apart.

Questions for a pool fence installer

  • Will you build to section R328 of the 2025 code, and my village’s rules if they are stricter?
  • Which gate hinge and latch, and where will the latch release sit?
  • Who files the permit and books the inspection?
  • If the house is one side of the barrier, how are the doors alarmed?
  • When can you start? Family Fence calls late May one of the best times to install and says June and July get busy.

Pool fence red flags

  • A walk gate that swings in toward the water.
  • A latch an outside hand can reach below 54 inches.
  • More than 2 inches under the fence anywhere around the run.
  • “The house counts as the fourth side” with no plan for door alarms.

The chain link page covers mesh sizes if you are fencing with chain link, and the gates page goes into hinges and latches for every kind of gate.

Worth pricing with a pool fence

  • Walk gate

The 2025 Residential Code of New York State says every gate in a pool barrier must be self-closing and self-latching. Price the gate and its hardware with the fence, not after.

  • Mesh pool fence

Family Fence in Bellmore sells Baby Loc removable pool fences, which set up and come down. It is worth pricing one next to a permanent fence.

Pool fence questions

  1. 1.How tall does a pool fence have to be in New York?

48 inches at the least, measured from the outside, and the gap underneath can be 2 inches at most. That is section R328.4.2.1 of the 2025 Residential Code of New York State. Some villages ask for more. Malverne's printout of the code notes that the village requires a 5 foot solid barrier.

  2. 2.Which way does a pool gate have to swing?

Out, away from the pool, for a gate people walk through. Every gate in the barrier also has to close and latch by itself (R328.4.2.7.1 and R328.4.2.7.2).

  3. 3.Does an above ground pool need a fence?

The code counts any pool that can hold more than 24 inches of water. For an above ground pool, the barrier can sit on the ground or be mounted on top of the pool wall, and a ladder or steps must be lockable or removable or fenced in themselves (R328.4.2.1 and R328.4.2.9). News12 reported in 2019 that the Town of Hempstead's code requires permits and safety fencing even for nonpermanent pools.

  4. 4.Do I need a pool alarm too?

Yes, for any pool or spa put in or rebuilt after the 2006 cutoff in the code. Section R328.6 requires an approved pool alarm that detects someone entering the water.

  5. 5.Can the back of the house be one side of the pool fence?

The code allows it if every door with direct access to the pool has an alarm that sounds within 7 seconds and keeps going for at least 30 seconds, or another approved protection (R328.4.2.8). The CPSC's barrier guidelines say a fence that goes all the way around the pool is better than one that uses the house as the fourth side.
